Privacy policy of Elkom Trade S.A.

Dear Madame/Dear Sir, bearing in mind the fact of entering into force of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to processing of personal data and on free movement of such data and repealing the Directive 95/46/EC (General Data Protection Regulation) hereinafter referred to as the “GDPR” we hereby inform you that we are processing your personal data. This information is the implementation of information obligation imposed by art. 13 and 14 of the GDPR. The provisions mentioned impose the information obligation on the personal data administrator towards data subjects, whereas art. 13 GDPR establishes the information obligation in the case of collecting data from any data subject, whereas art. 14 GDPR establishes the information obligation in the case of collecting data from other sources that data subjects. Given the above, we inform you that:
  1. The controller of your personal data is Elkom Trade S.A., with its registered office in Warsaw (04-028), at Al. Stanów Zjednoczonych 51/622 A, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under number 0000527982, Tax Identification Number (NIP): 1132823532, National Business Registry Number (REGON): 142754068, with share capital of PLN 1,314,375.00, fully paid up.
  2. Your personal data are being processed by us pursuant to art. 6 para. 1(b) of the GDPR in connection with the performance of the agreement and pursuant to art. 6 para. 1(f) of the GDPR e. data processing is indispensable for the purposes arising from legitimate interests realised by the administrator. Legitimate interests referred to in previous sentence is Company’s business operations, and in particular offering products and services, as well as claiming damages on the account of business operations conducted. Processing of data about our Customers serves also other purposes associated with business operations conducted such as marketing, analytical and statistical purposes.
  3. For the aforementioned purposes we process your personal data: first name, surname, position, company’s address, business telephone number, company’s e-mail address, bank account number, NIP, whereas personal data of your representatives, including your employees will be processed to the following extent: first name, surname, position, business telephone number, company’s e-mail address.
  4. Your personal data will be processed by the Company for the period of time required to achieve the goals referred to in item 3 above.
  5. Your personal data may be transferred to different categories of recipients in the following areas:
    1. handling of payments,
    2. accounting and fulfilment of duties imposed by accounting regulations,
    3. maintenance services,
    4. postal services, courier or logistics services in connection with the performance of the agreement,
    5. marketing campaigns,
    6. transfer of data to Elkom Trade S.A. related entities.
  6. Your personal data will not be transferred to recipients outside the European Economic Area or to international organisations.
  7. Your personal data will serve to make decisions which are based inter alia on automated processing, including the profiling referred to in art. 22 of the GDPR.
  8. Your personal data has been acquired by the Company from the following sources: in connection with the performance of the agreement, website, internet and commercial databases and industry conferences.
  9. Your personal data are being processed in an electronic form (stored in Company’s database) and/or in the paper form.
  10. The Company represents that organisational and technical measures taken aimed at providing safety of personal data processing meet the requirements imposed by the GDPR, in particular the provisions of art. 32 of the GDPR.
  11. Bearing in mind the processing of your personal data, we inform you that you are entitled to:
    1. request from the Company to access your personal data and correct them (pursuant to art. 15 and 16 of the GDPR),
    2. delete or limit the processing of your personal data (pursuant to art. 17 and 18 of the GDPR),
    3. file an objection against processing of your personal data (pursuant to art. 21 of the GDPR),
    4. transfer your personal data (pursuant to art. 20 of the GDPR),
    5. file a complaint to the supervisory body, which is the President of the Personal Data Protection Authority.

Information on cookies

    1. Website does not automatically collect any information except of information contained in cookies.
    2. Cookie files (the so-called “cookies”) are informational data, in particular text files which are stored in the Website User’s device and are intended to use web pages. Usually, cookies contain website name, from which they originate, time of storage on user’s device and a unique number.
    3. The entity which posts cookies on the website user’s device and acquiring an access to them is the Elkom Trade S.A. Website operator.
    4. Cookies are used for:
      a) adapting the content of web pages to the User’s preferences and optimizing the use of web pages; in particular these files allow to recognize the Website User’s device and properly display the web page, adapted to his/her individual needs
    5. b) creating statistics which help to understand how the Website Users use the web pages, which allows improving their structure and content;
    6. As part of the Website, two basic types of files are used: session cookies and persistent cookies. Session cookies are temporary cookies which are stored in the User’s device until logging out, leaving the website disabling the software (internet browser). Persistent cookies are stored in the User’s device for a period of time specified in cookie file parameters or until their removal by the User.
    7. As part of the Website, the following types of cookies are used:
      a) essential cookies that allow using the services available as part of the Website, e.g. to authenticate cookies used for services requiring the authentication within the Website;
      b)cookies used for providing safety, e.g. used for detecting abuses as regards the authentication within the Website
      c) „performance” cookies, that allow collecting information about the way of using the web pages;
      d) “functional” cookis that allow “saving” the settings selected by the User and customizing the User’s interface, e.g. with regard to language selected or region from which the User originates, size of fonts, appearance of web page etc.
      e) „advertising” cookies that allow providing the User with advertising content better adapted to his/her interest.

    In  many cases the software used for browsing web pages  (Internet browser) allows storing cookies in the User’s device by default. Website Users may change their settings regarding cookies at any time. These settings may be changed in particular in such a way as to block automatic cookies support in Internet browser settings or to inform each time about their posting in the Website User’s device.     The Website Operator informs that limitations of using cookies may affect some functionalities available at web pages.

    Cookies posted at the Website User’s device can be also used by advertising providers and partners  cooperating with the Website operator.
